Terms and Conditions

By booking Tam delaCruz (ganda nitto) as your photographer or/and videographer, you are entering into a contractual arrangement that is bound by the following terms and conditions:

It is agreed upon by both parties that these terms and conditions act as a contract between both parties in full and no amendment to the contract can be made except one agreed by both parties in writing.

Upon booking Tam delaCruz the client agrees to pay a non-refundable deposit of £45.00 (forty-five sterling pounds) of the total fee of the shoot. On or prior to the date of the shoot the client must pay the remaining session fee. Further charges, for edits, expenses etc, will be charged after the session and on delivery of the final images.

Cancellations made within 48 hours of the shoot date by the client will result in a forfeiture of any monies paid.

Every effort will be made by Tam delaCruz to honour this contract, but the client understands that on occasion it may not be possible, for ill health for example. If this is the case, Tam delaCruz will offer the client an alternative date, if this is not possible, then full refund will be made of any monies already paid.

Tam delaCruz will provide an edit inline with the agreement prior to the shoot day, which involves a light skin retouch, blemish and a pleasing colour balance. All efforts will be made to match colour but the client understands that it is sometimes impossible to make exact colour matches. The clients can request specific edit in advance.

Blemish removal and skin softening will be agreed upon in the shoot, and any specific editing must be discussed on the day. Further editing of the images such as colour toning or object removal will be free of charge depending on the object and request. The client must not edit, colour tone or add filters to the images without notifying Tam delaCruz. If the photographs are to appear in a design context where editing will occur, this must be discussed prior to or during the shoot. If a client is unhappy with edits done, please contact Tam delaCruz to discuss.

Video productions will be agreed upon prior to the shoot, any specific story telling, editing must be discussed and planned in advance. The client must not edit the video without notifying Tam delaCruz. When filming and the clients or Tam delaCruz noticed that some minor adjustments are needed, this must be discussed during the shoot

Tam delaCruz will provide a sample video edit inline with the original agreed filming plans, before finalising the final video edits, the client will have an opportunity to review the clips and can suggest some changes inline with the original plans if the clients would want to have any excessive additional changes will be chargeable per hour. If a client is unhappy with edits done, please contact Tam delaCruz to discuss.

Copyright of all images and videos taken during the session, that are part of this contract, remains with Tam delaCruz unless otherwise agreed in writing, and are protected by the Copyright and Design Act 1988. Tam delaCruz gives the client the right to use the content to promote themselves and their business online on their own website, Instagram, LinkedIn and other social media platforms, and in printed promotional and marketing materials. The resale of contents that form part of this contract is prohibited. If a third party is interested in purchasing the images for any use, the client must inform the third party to contact Tam delaCruz to discuss usage rights.

Although Tam delaCruz will do his best to shoot as many images as possible, there is no guarantee exactly how many images will be made in the shoot.

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

If you decide to choose me as your photographer, and you book a photo or video session with me, it is your responsibility to let me know about anything you are not happy with during the session, so that we can work on it and fix it before you leave. I want nothing more than for you to be completely satisfied with the results from your session and I will work with you using a variety of coaching techniques to bring out the best in you. I will listen to your comments regarding how you feel about the content we are creating. Once you have chosen your favourite contents and have left the session, I can accept no responsibility for how others feel about the digital contents we have selected and agreed together, and that we regard as the very best from your session. As stated above, anything that you feel could have been improved upon, should have been discussed during the session.

If at any point Tam delaCruz is subjected to threatening behaviour, abuse or harassment, the client agrees that Tam delaCruz will not be expected to continue to provide any further session coverage as outlined in this contract, and there will be no action taken against Tam delaCruz with regard to any refund of money to be paid for the session coverage not completed. Tam delaCruz will notify the client of any threatening behaviour, abuse or harassment as soon as possible after it has occurred and will continue to provide the digital content coverage outlined in this contract if the issue is dealt with and no further threatening behaviour, abuse or harassment takes place. If the issue is not dealt with after the client has been notified, Tam delaCruz is within their rights to discontinue providing the session coverage outlined in this contract and in extreme cases it is agreed that the local police may be informed of the threatening behaviour, abuse or harassment.

Shoots done as part of a TFP or collaboration will result in the production of the digital content that both parties can use for promotion. It is expected that the model will post these images on their social media in good time after the shoot and with full creditation to the photographer or/and videographer. Both Tam delaCruz and the model will adequately credit each other in this instance. And a model release will be signed.
